commercial sublease
Novemeber 2007, i entered into basically a commercial sub-lease agreement along with a agreement to pay for equipment in a salon. the agreement was wrote up saying that i am responsible for the utilities and the taxes on the salon, but does not specify previous taxes. i am responsible for the date of occupancy. the leassor has decided to not pay her previous taxes and try to force me with paying them. now saying if i dont pay i have to leave the salon, losing all the money i have put into it and revenue the salon is bringing me. what kind of recourse do i have? i have paid the lease and her on time with copies of checks as the contract we have as proof. also the landlords are agreeing with me on whose responsiblity it is. her actual lease is over july, then the my lease starts. i am scared that this will get ugly.
Re: commercial sublease
I would want to review both your sub-lease agreeement as well as primary lease, and see tax statements. You cannot be forced out without a UD proceeding where it is established that you have DEFAULTED on your agreement.
ANy chance of LL evicting primary Tenant and letting you stay in their place?
