Changes in Living Will Laws?
My parents, in their late ’70s now, had a living will drawn up by a lawyer in 1998. Now they have heard ‘thru the grapevine’ that changes in the laws regarding living wills in California make it mandatory for them to have a lawyer update their living will. Is this true?
Re: Changes in Living Will Laws?
It is not required that an attorney prepare a living will or living trust, but this is preferable. I have reviewed many poorly drafted living trusts that require extra expense to fix after someone’s death, and there are others that are too broken to fix. That said, I’ve seen good ones prepared by non-lawyers, but unfortunately, there’s no way for the client to know until an attorney reviews it.
