Hi, I have purchased a flat in Pune from a person having his father’s Power of Attorney. The POA had his father’s signature & photo & thumb impression. It was notarized. The sale deed was registered & I got the flat transfered in my name. The son also gave me Indeminity bond. Latter I came to know that the POA was fogged & the son has signed his father’s signature & disposed off his flat with the fake POA. I did not know all of this before buying this flat.
Now can the father, whose flat it belonged to cancell the sale deed & demand me to vacate the flat ?? I am staying with my family & do not want to be bothered as I have paid the price for the flat.
I am in a lot of tension. What mesures do I have to take to stay peacefully with my family in the flat ??

Sir, I want to sell my shop, but the buyer insists to make sale deed which he does not want to register. Instead he wants a power of attorney on his name by which he can sell it to another party in my absentia. Is there any harm of doing so? What will be the legal implementation and how I will show this money into my Income tax return.

1. ‘A’ gave a registered GPA to ‘B’ in 1990 for sale of property. B entered into an agreement of sale with A for a consideration
2. ‘A’ revoced the GPA on 3-1-2005.
3. B registered the property in his wife’s name on 10-1-2005
4. concealing the revocation, B’s wife sold the property to ‘C’ in 2006 (sale deed registered without the issue of revocation popping up,all parties concealing the same). ‘A’ signed as confirming party to the deed.
5. Title of ownership is not being transfered inthe name of ‘C’ by the office (the tilte is still in the name of A)
Please advice on:
1. what should C do now? Is there any recourse
2. Can the revocation of GPA be cancelled by A now?
3. Can ”A’ issue a fresh GPA (not registered) (back dated )in the name of B’s wife to make the sale deed valid
4. Is there any legal recourse for mental agony
5. will a No objection certificate from ‘A’ suffice now?

Power of Attorney
My father wants to grant me power of attorney for a real estate transaction that he is involved with. I have bought the form that is entitled District of Columbia Limited Power of Attorney for Real Estate Transactions. THe form does not specifically mention the District though. Is this the correct form? Also, once the form has been notorized, what are the next steps. I understand that it has to be there for the settlement, but does it have to be recorded with the District of Columbia? Are there any other steps that have to be taken once the form is notorized?

Selling a property when there is no power of attorney
I am one of five siblings whose mother is incompetent. I believe there is no power of attorney. She is currently living with one sibling who has not paid taxes on her property or his own since 1997. He has told his siblings he would be taking care of this when we found out a few weeks ago but has not. Both houses are still on the anticipated auction list; soon to be put on confirmed auction. If we can arrange payments of the tax liens on my mother’s property, would siblings be able to sell property without power of attorney or do we need to wait until it becomes part of her estate? Also, what would it take to force the sibling in control to reveal all her financial records to the other four? He is thankfully taking fairly good care of her, however, he refuses any outside help, nursing home for mom,or help with paying bills, etc. I don’t know if he has been paying her other bills, but he has been handling her finances for about 15 years. Answers to my questions and any other advice would be greatly appreciated.
