My sibling had been appointed executor of both our parents wills, this was done by our parents only because I live out of state. I had been appointed with the Durable Power of Attorney for both parents about two years prior to their passing. Less than a week of our dad passing my sibling went out and had the DPOA’s changed to him. At the time it seemed o.k. but as soon as dad passed he told me to “get out of town”. I have found that the person who notarized the POA’s possibly was not there with my parents to witness when this was done. My sibling refuses to tell me who witnessed and notarized the DPOA’s. There is no cooperation from my sibling so I believe that this is true. How and where would I start to see if all was properly done? I wish to pursue this and have this resolved.

I have been durable poa and medical poa for my mother since december 16, 2002. Since then mom had to be placed into a nursing home. Now some of the family members are furious. They haven’t helped or contacted mom for quite a while. Now they are trying to break the poa contract. I did notify most of my siblings. However, a few I did not contact in December. Now they say it is void. It was prepared by an attorney and recorded. Was it mandatory for me to send them a paper copy at the time I recorded it? Can that make it void?

My father died last week in St. Louis at age 93. I have had General Durable Power of attorney since 1997. He remarried in 1999 at age 93 while suffering from Alzheimer’s. His life insurance beneficiary was changed to his wife’s name, even though I had power of attorney at that time. Did he have the legal authority to change the beneficiary from me (his daughter) to his present wife? and do I have legal recourse now?

Secondly, I found a cashier’s check made out to my father dated 1996 while cleaning his house last week. The bank says they need a letter from the Probate Court before they can release it to me. The check was endorsed by him and I had power of attorney at that time.
