I am durable power of attorney for my dad and his house is in my name by way of a life estate. In his will he has my sister and my brother as being entitled to equal shares of his estate. I have lived in the house for 2 and a half years and have done major repairs and improvements. I have paid the property taxes and also have an 18 month old daughter living there. the house was put in my name before the will was made and I have been the one caring for my dad for over 5 years. Upon his death will I have to sell the house and divide the money between siblings?

My mother who is 88 years old had a stroke last week. First one. She is now hospitalized in Nevada County, California. Up to the time of her stroke she was able to completely handle her affairs but this time is no longer competent to handle them. She is now limited in speech, can not write, walk or do anything for herself. She has some comprehension but can not communicate very well because the stroke has affected her speech. Most likely she will never come home again and will either remain hospitalized or stay in a nursing home. She has given a Durable Power of Attorney to my nephew who is a schizophrenic. Not a great choice. Here is my question. Since she is unable to deal with everyday finances, bills, mortgage payments etc I need to take care of them to keep her estate intact.

My father died without a will. He and my mother owned land jointly,and he also owed land in his name only.My mother always said she didn’t want the land that was in his name” it was junk,” now that he has past she says she owns everything including all bank and I R A accounts and life insurance policies one of which the benifiary was his estate. All this has been probated on the advice of my sister. Now mother has written a wiil again on sisters advice and given sister durable power of attorney. Also my father granted me an access easment across part of thier jointly owned land. Now mother wants to sell all the land. Was all this handled properly and legaly?Any thoughts or advice would be greatly appreciated.

I was made agent (attorney-in-fact) in a Statutory Durable Power of Attorney for my mother. This was executed December 9, 2003 in Texas. My mother died January 23,2004 following surgery for a brain tumor. Her Will written in Oklahoma ~ 1999 has her preacher as the Administrator. I know she wanted me to be the Adminstrator of her Will. Does my being named Agent in the Power of Attorney replace the Adminstrator named in her Will? This Statutory Durable Power of Attorney has broad and sweepin powers including estate, trust and other beneficiary transactions.
