My father recently passed away and his surviving spouse says his Will was ”absolved” a few years ago. I’ve learned that a quit claim deed was issued in 1996, but my father’s name is still listed on the deed. Could the quit claim deed have been to remove my own deceased mother’s name from the property and to add my step-mother’s instead, or did my father relinquish his portion of ownership of the property in full to my step-mother by filing the quit claim deed? Where would I find this information? How can I find out whether or not he changed his original Will? Will the attorney who prepared the latest Will contact me? Are any of my father’s children entitled to receive any of his estate, including his share of the property. My step-mother states there is no Will at this time. Thank you.

Apparently under HIPAA, your physicians could not disclose medical information to your Agent/Successor Trustee, so they could determine if your were incapacitated, which is necessary for them to make medical and/or financial decisions.

Mother-in-law’s trust gave money to husband since 1999 (she is in nursing home with alzheimer’. Sister took guardianship. My husband died in accident. Sister is directing trust to cut me off. I will lose my home without their help. Husband had me sign with him to refinance our home because he felt trust would continue to help. I am disabled with half his income and larger house payments. Offer to sign up for mortgage ins. came day he died. Can sister as guardian (and beneficiary also) direct trust. I cared for her parents and my ill husband for 25 years. she was never around, but now acts as doting sister and daughter. My husband had M.S. and his parents helped us and gave equal amounts to his healthy, wealthy,sister, to be fair. I feel a precedent has been set and I have been left to hang. Do I have any legal rights as a benefciary?

When my father died five years ago, he had no living will. In the state of Texas I am told that if there is no living will then everything is split 50/50. Meaning 50% to spouse and 50% divided between children. My stepmother then proceeded to draw up her own will and have my aunt forge my father’s name and then go as far as having someone notarize this said will under the table. With this will, She received a life insurance policy of $120,000 and $25,000 of a 401k plan. I had two half siblings that were under the age of 18 at the time of my father’s death living with her. They both received SSI payments of $900 each until the age of 18. They didn’t receive any of the other money either. What should I do or what can I do in this situation.
