How do we avoid the legal hassle of probate court
I live in California and have two older siblings that live in New Jersey and our mother lives in New Jersey as well and will turn 81 this October. What is the best way for us to avoid the legal hassles of probate, estate taxes and inheritance taxes that will come about if and when the time comes when our mom passes? Would placing one or all of us on the deed of the house by use of a quit claim work?

my father and his siblings inherited a parcel of land in PA. The siblings gave their brother DPOA to sell. He bought out his siblings but did not have them sign a deed nor did he register a deed.
He willed the land to his wife and 2 children. the 2 children quit c laimed their portion to their mother.
The mother died and willed back the land to the kids. They sold the land. The Co. that bought the land cannot obtain clear title and want the original heirs children to sign a quit claim (original heirs deceased)
He wants to lease the land to the Gas co to drill in Marcellus Shale. Do we have an interest in this land? Can we claim ownership? The Co that bought the land has been paying taxes and thinks he can get the court to give him Quiet Title.
I know this is complicated, but we need to know if we should move forward to try to A. show interest
or B. try to show ownership which would then require an atty in PA

Quick / Quit Claim Deed – Dying Mother
In 2004 my mom’s house was refinanced with myself. We are now both on the title, where she signed a quit claim deed with me with right of survivorship. Now she’s passing away and she wants me to sign a deed giving my 50% back to her, so she can give the house to all of us kids and let us all split 4 ways (4 kids) the money left over after the mortgage is paid. My question, if this happens because I’m the main one on the mortgage, and the house is sold, are they obligated to pay off the mortgage or am I stuck with a $150,000 loan still owed since I surrendered my rights to the entire house? Any advice or explanations of what this means would be appreciated.

Property as Tenants in Common
My father just passed away and he created a trust in 1995. My mother passed away in 1993. When dad created the trust he held a piece of property with my mother as tenants in common. He never took her off title and he never put the land into his trust. What can we do now since both of my parents are dead? I have the quit claim deed that the attorney prepared in 1995 (signed and notarized but never sent to the recorder’s office). Thank you for your help.

Mom & Dad’s credit card debt
My dad passed away 2 yrs ago, my mom passed away last month.
They owed apprx $30,000. in credit card debt. They were buying a mobile home on 1/4 acre of which they have quit claimed to me. The existing balance owed on the mobile is $31,000. Mom stated in her simple will that the mobile home goes to me and signed a notorized quit claim deed, as well as a Power of Attorney.

The credit card collectors are calling every day.

My question is: can the credit card companies take the outstanding amounts owed from the ”estate”? Aren’t they considered unsecured loans, and therefore not the responsibility of the estate to pay them?
