Abuse of Power of Attorney
My dad died 4 months ago, mom is incomtant. brother has durable power of attorney, has put mom in assisted living and has got himself a fancy apartment, all though he has no job. He says he has to take care of my mom, assisted living is $4,500 a month, he is there 20 minutes a day. How do we know if he is using her money to live on, he keeps everything scret. My mom of course isn’t able to understand and do not really want to upset her. He wants no one to know what dr she goes to or what dr says. Is there anything at all we can do, to know what is going on or to protect my mom? For example phone bill was $700, mom can’t hear to use phone, he paid $5 to her, told her it was his potion of calls and wrote a check for $700 which he said was her potion. thank you.

My father passed away in May of 2004. He did not have a will. He had cared for my 84 year old Grandmother. In June 2004 without having allot finances I downloaded a Durable Power of Attorney, that my Grandmother signed, which was witnessed and notatrized.
#1 Is this a legal document?
#2 My fathers wife(stepmother) is part owner of property-by estate law, with my Grandmother. Since I have the power of attorney, can my stepmother sell this property without my permission?

Challenge the authority of Uncle (with alzheimer’s) DPOA ?
My 92 year old uncle died yesterday. I am his only living
blood relative. My uncle lived in Illinois and I live in
Oregon. When my uncle was put into a nursing home a
month ago I got a call from R, a man who said he has
”power of attorney” because my uncle ”had become
mentally unable to pay his bills”. R stated that he ”had
to step in”. I have never asked whether or not R has
durable power of attorney, but it is beginning to appear
that he does because he has arranged my uncle’s
funeral and talks to me as if he has complete control.
My uncle had full blown alzheimers and now I do not
know what will become of his property. I am, of course,
now suspecting that R has continued access to all my
uncle’s money, bank accounts, property etc. R has
scheduled the funeral in less than two days and I would
be hard pressed to get there in time even if I had the
funds to go.
Should I ask R what is his authority at this stage?
should I ask R who my Uncle’s lawyers are? I am
nervous that R has
made my Uncle sign things over to him (and that is
REALLY not right since he had alzheimers!)

My husband has durable power of attorney for his father, who is incapacitated at this time. My husban’ds own health is now failing and he wants to know if he can name me as his father’s co-power of attorney to insure that his father is taken care of should something happen to him. Can we do this since his father is incapable of speaking for himself?
