Heritage property
We have heritage property in my family for generations on my mother’s side of family.When she passed away,all her children were informed if they didn’t sign everything over to their father, the bank would demand full payment of a lean against property. Since we signed, our father has sold over half the farm, give the rest of the farm to one son, remarried and filled out living will for house to go to new wife, which he didn’t pay for the house. Is it legal for him to leave 4 out of 5 children out of property that was passed down throught generations?

In distribution of monitary assets from a living trust valued just under 300,000 are there any taxes to be paid by the heirs? Each heir will receive under 50,000.

All estate papers done by attorney and were properly executed some years ago– Last Will and Test, Living Will, Durable POA and Desig of Health Care Surr. As currently reads, all duties and respon, accross the board, on all docs to be shared and/or decided by son and daughter. I wish to replace son with sister on all docs. Can I do so with a codicil to cover all four docs or do I need to redraft?

I have a child that will be born in March, chromosome disorder and the child is not going to live. I need to know if a Living Will is something I can take to the hospital with me so the hospital will provide ”comfort care” and listen to our wishes. Is this the correct form?

My husband suddenly took ill and passed away last month. He did not have a living will or Trust set up. He did not own any property. He did have a Life Insurance policy for which I am the beneficiary. He had a savings account under his name and owned a vehicle. He has outstanding balance on some credit cards and medical bills that need to be paid. Am I liable for his credit card balances? Do I have to go through a probate court in order to pay his debtors or could this be resolved by setting up an Estate/Trust since he did not own any property? What is the best way to handle this ? Please advise.
