I have taken total care of my dad since mom passed away March 15, 2008, He is blind, end stage renal disease, dialysis 3 times a week, and has many other health problems. I moved in his house to care for him since my brother and sister will have nothing to do for him. He titled over the mobile home to me back in May stating that this was something he and mom wanted to do. He has left them things as well-My sister got the car, my brother gets some antiques, His will (made back in 1987) states that any money left will be divided between the 3 of us kids. Since they haven’t helped care for him or even been by to see him since mom passes away, is there a charge I an charge his estate when he passes for my time of caring for him and the personal money spent for him. My dad is now 85 and I am 55 and am disabled myself.

Live in Calif. divorce final in 60 days. I got the house, wife got the 2nd mortgage. 2nd mortgage is interest only payments until 2011 then a balloon payment of $60,000 due.

Question:(s) Can I have wife sign quit claim deed and take her name off DOT on 1st mortgage. Do I remove my name off 2nd DOT.

When Judge ordered wife responsible for 2nd he put in a hold harmless clause what does that mean to me. Any thing I need to know other than if she default on 2nd they could very well force me to sell home.

I am in the process of getting a divorce from ”D”, who happens to have a susbstance abuse problem. I kicked him out of the house in 11/05 when he relapsed. He hasn’t paid any child support but agreed to continue paying the mortgage so both our only son (8 yrs old) could stay in the house. Come to find out, he lost it all (hasn’t worked since ’05) and never made a mortgage payment (his mother did). I also found out that the mother owned the house, my husband never did. In September, her lawyer sent us a notice to quit giving us 90 days…Since I get no financial help from the father (her son) it has been very difficult to find a house comparable to the one we live in. I may need more than 90 days!!! I can’t afford to pay my in-laws any $ as I’m trying to save for the down payment. Under these circumstances, do we have any rights? Could we stay longer? Also, during the aforementioned 90 days, my brother-in-law bought the house from his mother…is the original notice to quit issued by the mother and her lawyer still valid even if the property has a different owner or should a new notice to quit have been executed ?

I want to apply through a gov’t agency to receive child support and health care from my spouse who has told me he doesn’t want to pay for health care. I know that since he is the non custodial parent he needs to provide health care coverage for our daughters. Is he required to pay the full amount of the health care or just a portion? and how much is that portion? I will be signing up my daughters through my insurance but don’t know how to obtain the money from him.
He has started a new job that his pay will differ each month based on the commission he receives. Can you tell me if the government agency will (Attorney General Office) garnish his checks accordingly? He has failed to provide check stubs to me and has already began to pay it late and only half of it this month and witout advanced warning he has told me he cannot pay the second portion until later in the month until he gets paid. In addition,when he does send his payments both checks are from different bank accounts.

Unfortunately my salary as a teacher does not permit me to hire a lawyer. Any recommendations or resources I can look up would be appreciated.
