Unauthorized withdrawl
I live in Massachusetts, my mother, 81, has dementia. I have her durable power of attorney. She’s gone to visit with my brother in North Carolina and he has made $2100 in withdrawls from her ATM in the last 10 days, bottoming out her checking account–possibly with my mother’s consent. If she needs to apply for medicaid in the next 5 years, someone will be looking for that money. Do I have the legal right to demand that my brother give the money back?

Durable Power of Attorney
My mother in law has a Durable Power of Attorney for a wealthy aunt with no children and no relatives living close. The aunt resides in a nursing home, she has dementia. My mother in law has very little money and a worn out automobile. She is on call 24/7 since she is the only one around to do everything, actually the others have been of no help what so ever. Can she legally trade in her car and purchase a fairly inexpensive car and pay payments with the aunts money as long as the aunt is alive and my mother in law is the sole caretaker? I see no reason for my mother in law to continue to wear out what is left of her car to continue to take care of someone who is wealthy. There is no compensation for my mother in law and there isn’t any specified in the Durable Power of Attorney. What would you suggest? Thanks for your assistance.–name removed–

I’ve been instructed to get a Durable Power of Attorney for my mother. I was told to ask for a ”Durable” POA because it would allow me to make all medical decisions for her if she was not able as well as taking care of all her financial things.
I found several places on the internet where you can buy Durable POA’s, Wills and Living Wills. They are less expensive than what the attorneys in town want to charge. What I would like to know is are they legal? Do I just need to get them notarized and witnessed when we sign them to make them valid? Are these type of documents still valid if you move to another state?

My sister has durable power of attorney for my Mother, who was diagnosed with Alzheimer’s Disease last fall. I am not too happy with how she is controlling everything for my Mother. She did contact an elder affairs attorney and put all of her assets into a trust. I’m not sure how she is handling the rest of my Mother’s assets. How do I go about finding out how to petition for power of attorney for myself and on what basis could I do this? Please advise. Thank you very much.
