Am I allowed to give out the personal information I have on file for my tenant to a business my tenant owes money?
My tenant breached his lease agreement by authorizing repairs to be made without notifying me. My tenant led the contractor to believe that he would be covering the cost of the repairs and that money was not an issue. My tenant is now trying to tell the contractor that I am responsible for the debt, which isn’t the case. The contractor knows that…the tenant knows that…everyone knows that. But, again, will I be breaking any laws by giving my tenants social security number / phone number, etc. to the contractor so he can pursue him for his money?
The contractor does not need that information to sue the tenant, only perhaps to locate assets in order to enforce a judgment. Since the information was given to you to use only for conflidential purposes, you have breached a duty to the tenant, although it would be difficult to tell what the damages are.
