a co-worker wanted to trade cars with me my wife wasn’t sure she wanted to trade we agreed to test drive the cars for one week i aurthized my loan co. to send them a copy of the amount owed on the car on the third day of having the car i called this person i was unable to reach him i left a mess. that i wanted my car back and did not want to trade. the next day he called back and said that he had already gotten a loan on the car and the title was on the way to him i never gave him a bill of sale released the title or gave a power of att. on the 7th day i took his car back to him the police were called and forced me to take his car back with me my car was not on the property i went to the place were i had a loan on the car and they said that they”assumed” i was selling the car because they got a check for the pay off how can someone else get a loan of my car without my having signed anthing to release it?
Re: trading vechiles
I assume nothing was in writing, is that correct?
It appears you may have a case for “conversion”, which is the civil version of theft of property.
There is a lot to discuss, however, more than this forum will allow.
If you will contact my office, I might be able to help you. If I were to take the case, I would do it on a contingency basis, where all you would have to pay me is the filing fee, for filing suit. I would be paid as a percentage of any recovery.
