Eviction – Prejudgment
I was evicted four years ago and noticed a judgement for $880.00 on my credit report. I assume it was for repairs or cleaning. I don’t believe it was lawyer fees resulting from the eviction. My rental agreement or contract doesn’t indicate anything about lawyer fees. I think their lawyer said something about prejudgement at the end of the hearing. Could this be for the cleaning or repairs or is that another court hearing issue? Is it too late to challenge the bill since it’s been over four years? A prejudgement? I am trying to find out why it’s $880.00 from the collection agency but they won’t provide any information.
Re: Eviction – Prejudgment
Chances are it is attorney fees and costs of suit. Any rental agreement is going to have a provision regarding fees and costs, and if it doesn’t there is a statute on point RCW 4.84.185 (I think, off the top of my head)
However, that said, the collection company has a duty to verify/validate the debt they are attempting to collect from you.If they can’t tell you what it is for, that is their issue, not yours.
You can check with the Clerk’s office of the court and get a copy just to see for yourself.
