Divorce Decree/No cooperation
I have a divorce decree. Wife is to receive funds from refinance of residence. Wife must sign quit claim deed prior to closing refinance loan, which frees up money to be granted to her according to the decree.
Problem: Neither she, nor her attorney will respond to ANY of my inquiries about the matter. I’ve relieved my attorney of her duties. All that is needed is simple compliance with decree directives. I have 60 days to comply with orders, but cannot get needed cooperation, i.e., signature.
I’ve sent emails, certified letters, phone calls, contacted the judge’s office to no avail.
What can be done? I’m hamstrung.
Re: Divorce Decree/No cooperation
The judge is not going to do anything for you ex parte, on the basis of your talking to him (and in fact it would be a violation of judicial code to do so). You are not hamstrung, you are just prematurely pro se. There are tools available: note and file a motion to compel execution of the decree.
