Multiple ownership
My parents in order to avoid probate put their house into multiple ownership. My sister owns 45%, I own 45% and my mother owns 10%. My dad died and my mother wants my sister and I to sign a Quit Claim Deed to give her full ownership, I refused. Do I have any recourse to 1. force her out of the house, 2. put the house up for public auction?
Re: Multiple ownership
It may be possible, depending on the facts of your individual case, to seek a judgment in court partitioning the property, or if that is impossible (in most cases except for vacant land) then you may ask for a judicial sale of the land or interest and division of the proceeds. Chapter 842 of the Wisconsin Statutes governs these types of action. If this is something you are interested in pursuing I would urge you to discuss the facts of your particular case with an attorney as soon as possible. Feel free to contact me to discuss your case at the e-mail provided below.
