notice to quit without lease
I need to begin eviction proceedings on my tenets but have no lease agreement with them. The ”notice to quit” document i downloaded contains language regarding the lease. Do i use this form or a different one. Thank you so much.

You should consider retaining an attorney to bring the eviction action against your tenants, especially if you collected a security deposit from them, because you could be found to have violated landlord/tenant law which may result in your being liable for double or treble damages and their attorney fees, if you did not handle things properly. It is not necessary that you have a written lease in order to evict your tenant.
The steps necessary to evict a tenant in Massachusetts are incredibly specific and time-sensitive, and you should probably speak with someone who handles evictions to make sure you are not opening yourself up to further liability.
You should also consider whether you should be using a 14-day notice to quit for non-payment of rent or otherwise.
