homeowners insurrance
I had a fence installed by a contractor who claimed they mapped out all under ground utilites. Over 3 years later my neighbors house had all thier electronics fried and the power company claims that it was because of a nick in the underground power lines from one of these posts installed buy the contractor. I am I personally responsible for this even though I had a proffessional do the work? in the small print they have a ”Hold harmless” clause in the contract which I think means they are not responsible for any damages.
Re: homeowners insurrance
Check with your homeowners insurance for coverage and a defense. Also while the contract has a hold harmless clause many states decline to enforce it for their negligence to you or others. You need to first check your policy and then if they decline you need an attorney to research the points. These are my quick thoughts that you can’t consider researched legal advice. Ask the power company for their report. They may be wrong. Why would your neighbors power line be on your property? They may have given the contractor wrong information on the location of the power line. The contractor might have placed the fence on your neighbors property. There are many unanswered issues to your question.
