advice on filing landlord tenant complaint
we have a month to month lease, have already given 30 days notice to vacate–tenant still there so we are getting ready to file a complaint–problem is knowing how best to word the complaint–is just wanting tenant out sufficient? We have many reasons to want him out but the instructions for filing say witnesses must be in court, that statements cannot be used–we don’t want to ask realtors and neighbors to come to court–so should we just stick to what we can say personally? thanks!

You are best off getting a lawyer who routinely handles landlord/tenant matters. Such a lawyer will have the forms and be able to advise you of what should be in the complaint, and will also be able to follow up to enforce an eviction if the tenant doesn’t leave on his/her own.
