If a person has property in another state and bank accounts in other states other than the one they are living in and wants to sign a durable power of attoreny, what type of form is needed, one for that state in which the person lives in?

    Usually the durable power of attorney would be on a form used in the state where the grantor of the power lives. However, the state where the real property is located usually prefers their own form, since they can’t be sure the out-of-state form is correct.

    If there’s going to be a financial transaction with the real property, banks and mortgage companies typically have their own particular form, and are not bound to accept other forms.
