Eviction
I am currently buying a home from someone who just yesterday decided that they do not want to sell it to me anymore. This is after I signed a Contract for Deed a month ago. I have been paying all of he utilities that are in my name, the lot rent and the payment. Now they say that I have 7 days to get out. I did not recieve any written notification. They called me and left a voice mail message. I would like to know what my legal rights are. Should I contact an attorney in my area and dispute this matter. The owner ripped up the contract and through it away and came up with some kind of excuse about me not being able to afford it (which I can more than afford it) and said since somethings have arrisen they want me out by thursday of next week. Can they legally evict me in the state of illinois with a verbal eviction or does it have to be written and delivered in person or taped to the inside or outside of the residence? Is the owner able to just rip up a contract for deed like they did? What are my rights?

    Don’t move out, the eviction was not properly effectuated because service was not proper — LL should have served you with a properly executed 5 day notice, and even THAT isn’t enough to get you off the premises. Also, if you and the LL have already begun the sale to you, he can’t just change his mind and tear up the contract — doesn’t work like that. Find a lawyer ASAP, it sounds like you’ve got a good case. If you have trouble locating someone in your area, contact the Illinois State Bar Association and tell them you need a real estate attorney in the Bloomington area.
