Who has the right to use the 3 day window?
In reference to a refinance on our home. The notary brought the papers to the house for signing. I was not aware that my husband would need to sign certain papers, I have general power of attorney, so I signed as such ”poa …..” I showed the quick claim deed, and she took my original poa with the documents. All paper work was completed on thur aft noon Sept.25, Late on Mon, aft noon, the title co said the would not except the poa as it was ”not spacific to the property” End of Deal! Three months time, rate, etc lost…. Do they have the right to do that? I know I have 3days,to change my mind, but I don’t see where they do??…Two weeks later the title co offered to close it with a higer rate and 1100. more in closing, plus out of pocket cash, I had two hrs to decide.
I said no.. Is there any thing I can do to inforce the exceptance of the papers signed on the 25th?
Re: Who has the right to use the 3 day window?
Yes they do. Closing of title has certain legal requirements which must be satisfied. Apparently your POA was insufficient for this transaction.
