General Power of Attorney
I am the father of a 9 year old boy. We live in Texas and I have physical custody of my son, however, his maternal grandmother is claiming to have General Power of Attorney over him. She wants him to go to California for the holidays, but for good reason, I do not want him to go. Is it possible that she has Power of Attorney, and does she have any rights? Her daughter (my son’s mother) is not capable of taking care of him due to a terminal illness & other reasons. Thank you for your time.

Your parental rights trumps her POA. Just say no.

If you do not have court ordered custody of the child,
I would strongly encourage you to do so.
Mom can be served through publication. It’s a pain to do it that way, but it can be done!
